Trainer shall assume that Owner desires surgical care if recommended by a veterinarian in the event of colic, or other life-threatening illness, unless Trainer is instructed herein by Owner or on Owner's Information Sheets, that the horse(s) is/are not surgical candidates.

Owner agrees to notify Trainer of any and all change of addresses, emergency telephone numbers, itineraries or other information reasonably necessary to contact Owner in the event of an emergency. In the event Owner departs for vacation or is otherwise unavailable, prior to departure Owner shall notify Trainer as to what party is authorized to make decisions in the Owner's place with regard to the health, well-being, and/or medical treatment of the horse(s).

However, Trainer will not be obligated to retain and/or maintain the horse(s) in question in the event the amount of the bill exceeds the

anticipated unregistered value of the horse(s.) In the event Trainer exercises Trainer's lien rights as above-described for non-payment, this Agreement shall constitute a Bill of Sale and authorization to process transfer applications from any breed registration as may be applicable to said horse(s) upon affidavit by Trainer's representatives setting forth the material facts of the default and foreclosure as well as Trainer's compliance with foreclosure procedures as required by law. In the event collection of this account is turned over to an attorney, Owner agrees to pay all attorney's fees, costs, and other related expenses for which a minimum charge of $250.00 will be assessed.

What is a Horse Training Contract?

A Horse Training Contract is a formal agreement between a horse owner and a trainer. This document outlines the terms and conditions under which the trainer will care for and train the horse. It includes details about fees, services provided, and responsibilities of both parties. By signing this contract, both the owner and trainer agree to adhere to the outlined terms, ensuring clarity and mutual understanding.

What fees are associated with the Horse Training Contract?

The contract specifies the monthly fee for training and board, which can be paid either monthly or daily. For instance, the owner might pay a set amount per month plus applicable taxes, or a daily rate. It's important to note that fees are due on the first of each month, and any late payments will incur additional charges. Owners should also be aware that there may be costs for veterinary care, farrier services, and other necessary treatments that are not included in the training fees.

What happens if my horse becomes ill or injured while in training?

If your horse requires veterinary treatment, the trainer will attempt to contact you for approval. However, if the trainer cannot reach you, they are authorized to seek emergency care to ensure your horse's health and well-being. All costs associated with this emergency care will be your responsibility. It’s crucial for you to keep the trainer updated with your contact information, especially if you’ll be unavailable for an extended period.

Can I terminate the Horse Training Contract early?

Yes, you can terminate the contract, but there are specific conditions. You must provide a written notice 30 days in advance. If you decide to remove your horse from training before the agreed period is over, an early termination fee may apply. Ensuring you understand these terms can help avoid unexpected costs.

What if my horse dies or becomes unfit for training?

In the unfortunate event that your horse dies or is deemed unfit for training, the trainer has the option to accept another horse or terminate the contract. If the contract is terminated, all outstanding fees must be settled before the agreement is considered complete. This clause helps protect both the owner and the trainer in difficult situations.

What are my responsibilities as the horse owner?

As the owner, you have several key responsibilities. You must ensure that your horse is in good health and provide proof of a negative Coggins test upon request. Additionally, you are responsible for covering veterinary and farrier costs, as well as any supplements your horse may need. Regular communication with the trainer is essential, especially regarding any changes in your contact information or emergency procedures. By fulfilling these responsibilities, you help create a positive training environment for your horse.

Common mistakes

When filling out the Horse Training Contract form, many people make common mistakes that can lead to misunderstandings or complications later on. One frequent error is failing to provide complete and accurate information in the designated fields. For instance, leaving the horse's name blank or not specifying the training goals can create confusion about the agreement's intent.

Another mistake is neglecting to read the entire contract before signing. This can result in overlooking important clauses regarding payment terms or the Trainer's liability. Understanding these details is crucial, as they outline the responsibilities of both the Trainer and the Owner.

Many Owners also forget to include the correct payment amount or the duration of the training period. This oversight can lead to disputes about fees later. It's essential to double-check these figures to ensure they align with the agreed-upon terms.

Some individuals mistakenly assume that verbal agreements made before signing the contract will be honored. However, the contract is the final word on all terms, and any verbal promises may not hold up legally. Always ensure that any agreements are documented within the contract itself.

In addition, failing to disclose any known issues with the horse can be a significant oversight. Owners should inform the Trainer of any dangerous behaviors or health concerns. This transparency helps the Trainer provide the best care and training possible.

Another common error is not updating contact information. If an emergency arises and the Trainer cannot reach the Owner, critical decisions about the horse's care may be delayed. Keeping contact information current is vital for effective communication.

Many Owners also overlook the section regarding the assumption of risk. Understanding that participating in equine activities carries inherent risks is important. Not acknowledging this can lead to complications if an incident occurs.

Lastly, some people fail to initial or sign in all required places, which can render the contract incomplete. Ensuring that every section is properly signed and dated is essential for the contract to be valid and enforceable.

Documents used along the form

When entering into a Horse Training Contract, it’s essential to have a few additional documents on hand. These forms help clarify expectations, responsibilities, and legal protections for both the trainer and the horse owner. Below are four commonly used forms that complement the Horse Training Contract.

  • Owner's Information Sheet: This document collects vital details about the horse and the owner. It typically includes information such as the horse's medical history, feeding preferences, and emergency contacts. Having this information readily available allows the trainer to provide better care and training tailored to the horse's specific needs.
  • Veterinary Release Form: This form authorizes the trainer to seek medical treatment for the horse if necessary. It ensures that the trainer can act quickly in emergencies, securing the well-being of the horse without waiting for the owner's consent. This is particularly important if the owner is unreachable during a crisis.
  • Liability Waiver: This document protects the trainer from legal claims related to injuries or accidents that may occur during training. The owner acknowledges the inherent risks involved in horse training and agrees not to hold the trainer liable for unforeseen incidents. This waiver is crucial for establishing clear boundaries of responsibility.
  • Emergency Contact Form: This form provides essential contact information for the owner and any designated representatives. It ensures that the trainer can reach the right person in case of an emergency involving the horse. This document is vital for effective communication and prompt decision-making regarding the horse's care.

Having these forms alongside the Horse Training Contract creates a comprehensive framework for the training relationship. They clarify roles, streamline communication, and enhance the overall experience for both the trainer and the owner. This proactive approach helps ensure that the horse receives the best possible care and training.

Similar forms

The Horse Training Contract shares similarities with a Boarding Agreement, which outlines the terms and conditions under which a horse is kept at a facility. Both documents typically detail the responsibilities of the owner and the facility regarding care, feeding, and veterinary services. They also address payment structures, including boarding fees and any additional costs that may arise. Like the Horse Training Contract, a Boarding Agreement often includes clauses about the facility's liability for the horse's health and safety, emphasizing the owner's responsibility for insurance and care decisions.

Another related document is the Veterinary Care Authorization form. This form allows horse owners to authorize a trainer or facility to seek veterinary care for their horse in case of an emergency. Similar to the Horse Training Contract, it specifies the owner's financial responsibility for any medical expenses incurred. Both documents aim to ensure that the horse receives timely care while clarifying the owner's obligations regarding payment and communication with the trainer or facility.

A Sales Agreement for horses is also comparable, as it formalizes the transfer of ownership from one party to another. This document outlines the terms of sale, including the price, payment schedule, and any conditions that must be met before the sale is finalized. Like the Horse Training Contract, it includes warranties about the horse's health and suitability for training or competition, protecting both the seller and buyer in the transaction.

The Lease Agreement for horses bears similarities as well, allowing one party to use another's horse for a specified period. This document details the terms of use, including care responsibilities and costs associated with the horse's upkeep. Much like the Horse Training Contract, it emphasizes the need for clear communication between the parties regarding the horse's health and training, ensuring both parties understand their rights and obligations.

A Liability Waiver is another document that shares common elements with the Horse Training Contract. This waiver protects the trainer or facility from legal claims arising from accidents or injuries related to horse activities. Similar to the training contract, it requires the owner to acknowledge the inherent risks involved in working with horses and assume responsibility for any potential injuries. Both documents aim to clarify the risks involved while ensuring that the trainer's liability is limited.

Finally, an Insurance Policy for equine coverage is akin to the Horse Training Contract in that it outlines the owner's responsibility for protecting their investment. This policy specifies coverage for risks such as injury, theft, or death of the horse. Like the training contract, it emphasizes the owner's obligation to secure appropriate insurance to cover any potential losses, ensuring that both parties are aware of the financial implications associated with horse ownership and care.

Misconceptions

When it comes to horse training contracts, there are several misconceptions that can lead to misunderstandings. Here are nine common myths about the Horse Training Contract form:

  1. All horse training contracts are the same. Many believe that all contracts are identical, but each one can vary significantly in terms of fees, services, and responsibilities. It's important to read each contract carefully.
  2. Once signed, the contract cannot be changed. Some people think that a signed contract is set in stone. However, changes can be made with mutual agreement and proper notice, as outlined in the contract.
  3. The trainer is responsible for all veterinary care. Many assume that trainers will cover all veterinary expenses. In reality, the owner is responsible for these costs unless otherwise agreed upon.
  4. The trainer guarantees results. A common misconception is that trainers can guarantee specific outcomes from their training programs. Results depend on many factors, including the horse's individual abilities and temperament.
  5. Insurance is provided by the trainer. Some owners believe that trainers carry insurance for their horses. However, trainers typically do not cover insurance for horses not owned by them, leaving owners responsible for obtaining their own coverage.
  6. All fees are fixed and non-negotiable. People often think the fees listed in the contract are non-negotiable. However, it may be possible to discuss and adjust fees based on the services provided.
  7. Owners can visit their horses at any time. While owners are encouraged to check on their horses, there may be specific times or conditions under which visits are allowed, especially if training sessions are in progress.
  8. The trainer will always notify the owner about emergencies. Many assume that trainers will always reach out in case of an emergency. While trainers will attempt to contact owners, they are authorized to make decisions if the owner cannot be reached.
  9. All horses are accepted for training. Some owners think that trainers must accept any horse. Trainers reserve the right to refuse horses that appear unhealthy or dangerous, ensuring safety for all involved.

Understanding these misconceptions can help owners navigate their horse training contracts more effectively and foster a better relationship with their trainers.
